Terms of Service

By using DashOps, you agree to: pay for your subscription, not abuse the service, accept that we provide it "as is" with limited liability, and resolve disputes in Georgia, USA. The full terms below govern. Please read them.

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of DashOps (the "Service"), provided by Octatude LLC ("Octatude", "we", "us", "our"), a limited liability company organised under the laws of the State of Georgia, USA. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of yourself or any organisation you represent. By creating an account, you confirm you meet these requirements.

3. Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@dashops.io of any unauthorised use. We are not liable for losses arising from your failure to keep credentials secure.

4. Subscription, billing, and free trial

  • Free trial. New accounts receive a 7-day free trial of the selected plan. No payment method is required to start.
  • Conversion to paid. After the trial, you must add a valid payment method to continue. If you do not, your account will be paused but your data is retained for 30 days.
  • Billing. Subscriptions auto-renew monthly or annually as selected. Charges are processed by Stripe. You authorise us to charge your payment method on each renewal.
  • Plan changes. Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing period.
  • Refunds. Subscription fees are non-refundable except where required by law. We do not provide refunds for partial-month usage following cancellation.
  • Taxes. Prices exclude applicable taxes (VAT, GST, sales tax), which we add at checkout based on your billing address.

5. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of Meta's Marketing API terms or Advertising Policies.
  • Attempt to circumvent feature limits or access tier-gated functionality you have not paid for.
  • Reverse-engineer, decompile, or disassemble the Service.
  • Resell or sublicense access to the Service without our written permission (white-label use under our paid plans is permitted).
  • Send unsolicited bulk emails through the Service or use it to harass, defame, or harm others.
  • Upload malicious code or attempt to gain unauthorised access to our systems or other users' data.
  • Scrape data from the Service or use automated means beyond the documented API.

Violations may result in immediate account suspension or termination at our discretion.

6. Intellectual property

DashOps and its underlying technology, design, and content (excluding your content and the content of your clients) are owned by Octatude LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for the duration of your subscription.

7. Your content

You retain all rights to the data you upload to or generate within the Service ("Your Content"), including campaign assets, audience definitions, branding assets, and lead form responses. You grant us a limited licence to host, process, and display Your Content solely for the purpose of providing the Service to you.

You are responsible for ensuring you have the right to use and upload Your Content, including your clients' data shared via your Meta integration.

8. Third-party services

DashOps integrates with third-party services including Meta (Facebook), Stripe, Resend, Vercel, Render, and MongoDB Atlas. Your use of these integrations is subject to those third parties' terms of service. We are not responsible for the availability, content, or practices of third-party services. If a third-party service is unavailable or changes its API, our Service may be temporarily affected.

9. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate your access for any breach of these Terms, with or without prior notice. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (e.g. intellectual property, limitation of liability, indemnification, governing law) will survive.

10. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, in no event shall Octatude LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claim arising from or relating to these terms or the service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Octatude LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of a third party, or your violation of applicable law.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Fulton County, Georgia have exclusive jurisdiction over any dispute arising from these Terms.

14. Dispute resolution

Before initiating formal proceedings, you agree to first contact us at legal@octatude.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve it informally, the dispute will be subject to the jurisdiction set forth in Section 13.

15. Changes to these terms

We may modify these Terms from time to time. Material changes will be announced via email to all account holders at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
